Mark,

Is there not also a distinction of having sent a confirmation of order?

So, having confirmed, the leqal position moves from offer of sale, to
payment offered, and on to offer accepted?

I doubt projectors FOC was ever a goer, just wondering?

Ian.

David,

Your understanding is correct.

However, if a retailer is advertising goods for sale at a price at which
they are unwilling/unable, they are obliged to take (immediate) steps to
remove the misleading advertising.

In this case, it's clear that the vendor took immediate steps as soon as
they realised there was a problem, and have therefore acted both legally and
honourably.

Regards,

Mark

I don't know if it is different for on-line orders under the distance
selling rules or even if the law has changed in the last several months but
I had to check out a similar situation once.

The office of fair trading (Bless them) confirmed that a vendor was not
actually obliged to sell. The explanation given was that no matter how
something for sale was advertised all a potential purchaser made was an
offer to purchase. The seller was quite within their legal rights to refuse
to sell - this was a point of law and not down to Ts & Cs. I can not
remember all of the detail but I think this was a provision of the Sales of
Goods Act - I may well be wrong here. I think this is explained in a FAQ on
the Office of Fair Trading WWW site.

I would be interested to know if I have been misguided, or, if there are any
other legal considerations - misrepresentation or what not.

Anyway, good luck, if you're successful when is the showing, I'll get the
beer where is the pizza coming from!

David.

Haven't checked the detail, but does it actually say anywhere that
the prices on the web are THE price list? My guess is that they'd
have a master list somewhere which is the legal one...
