It would be worth referring this to your CC company.
 
If this were the UK, it would not be possible for him to do this under the Consumer Protection (Distance Selling) Regulations 2000.
 
This clearly states:
 
    (5) Subject to paragraphs (6) and (7), the supplier may make a charge, not exceeding the direct costs of recovering any goods supplied under the contract, where a term of the contract provides that the consumer must return any goods supplied if he cancels the contract under regulation 10 but the consumer does not comply with this provision or returns the goods at the expense of the supplier.
 
 
I think that one could argue that, by virtue of having agreed to ship to the UK, the supplier was entering into a contract. Now, assuming that your credit card is a UK one, then I think one could further argue that UK regulations would have to apply to any dispute concerning payments on that credit card...

I ordered a turbonet kit for the TiVo last week. Confirmation states it wouldnt ship till this week.

Now, as I've been unimpressed by said TiVo, I didn't think I wanted to waste $100 - so I mailed to cancel the order. Now, Mark at 9th tee says that's fine, but there's a 10% restocking feee as per his Ts&Cs !! ( http://www.9thtee.com/termsshipping.htm )

The Ts&Cs seem to state a 10-25% for RETURNS...now as the order hasn't even shipped from the, I can't see how this can be classed as a return.

!!!
