I'm not convinced. The term in question reads:
"...3rd Party Products, Software and IM specified by you "
I think that a reasonable interpretation is that the customer did not
SPECIFY a third-party item. Instead, they chose a bundle as a complete
package on the understanding that the 3rd party item had been chosen by
Dell
specifically to work with their equipment.
Otherwise, I think it's an unfair term. The Sale of Goods Act was written
specifically to PREVENT this kind of "washing of hands" by
retailers, and in
supplying equipment to you on a Dell invoice, they are acting as a
retailer.
I would recommend a call to Trading Standards in the morning...
