I'm not sure on this now Mark but it used to be that the warranty period on
Tivos ran from the date the first subscription was taken out (or the first
tel call made) - if that's still the case the unit will be in warranty now.
Also there are a few people around here (me included) with the original
Tivo
HD's that they have removed when they upgraded so it shouldn't be too
awkward if it is the drive.
